By uploading or submitting any design, artwork, or PNG file to Made on Main (“MOM”), you represent and warrant that you either own the copyright to the uploaded file(s) or you have obtained all necessary licenses, permissions, or rights to use, reproduce, and print the file(s). You agree to indemnify and hold harmless MOM, its owners, and its affiliates against any claims of copyright infringement, trademark violations, or unauthorized use of intellectual property resulting from your submission.
MOM is actively testing its online ordering and submission platform. By using the platform, you acknowledge and agree that orders may experience technical interruptions, delays, or errors. In the event MOM cannot fulfill your order due to technical issues, production errors, or other limitations, your order may be canceled and you may be required to resubmit. MOM is not responsible for consequential or incidental damages arising from canceled or delayed orders.
By submitting artwork and placing an order, you expressly grant Made on Main the non-exclusive, royalty-free right to use uploaded graphics for internal and external marketing purposes, including but not limited to online advertising, social media, and promotional materials, and to record and display the printing process (including but not limited to print runs, curing, and cutting of gang sheets) for educational or marketing purposes.
You acknowledge and consent that MOM frequently conducts live broadcasts of its production process for transparency, education, and promotional purposes, and that your submitted designs and print jobs may be shown, streamed, or recorded publicly during such broadcasts without additional notice or compensation.
MOM’s total liability for any claim relating to an order shall not exceed the purchase price actually paid for that order. MOM disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement, except as otherwise required by Tennessee law.
If you choose the “Place in After-Hours Locker” option at checkout, you acknowledge and agree to the following:
No refunds, reprints, or replacements will be provided for orders affected by environmental exposure in the after-hours locker.
You agree that any dispute, controversy, or claim arising out of or relating to these Terms of Service, your order, or your use of MOM’s services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Dyer County, Tennessee, and Tennessee law shall apply. Arbitration shall be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Except for enforcement of arbitration awards, these Terms of Service shall be governed by and construed in accordance with the laws of the State of Tennessee.
By uploading a file, submitting an order, or otherwise using Made on Main’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the agreement to arbitrate disputes.
